Garage Conversion in Milpitas

A combination permit, and sometimes Fire
The City’s Garage Conversion Plan Requirements (opens in a new tab) sheet says a combination building, mechanical, plumbing, and electrical permit is required for residential garage conversions. Some projects also need a separate fire-protection permit from the Fire Department. The Garage Conversion page (opens in a new tab) links that sheet and says to contact Engineering at (408) 586-3329 or Planning at (408) 586-3279 about feasibility before you prepare plans. Those are City numbers.
The sheet asks for one printed plan set and a PDF when you submit over the counter, with existing work labeled (E) and new work labeled (N). It asks for a site plan and floor plans, and for the scope, areas, and codes to be stated on the first sheet. When the conversion is an ADU, access, parking, fire separation, sound separation, and utilities belong in that set. The sheet also says to confirm whether a slab is post-tensioned before anyone cuts it, because cutting a tendon is dangerous and expensive. If a homeowners association governs the exterior, the owner has to obtain that approval.
Pair the plan sheet with the ADU page
A garage that will be a legal secondary unit still has to meet the ADU rules on the City’s ADU page (opens in a new tab), which cites Municipal Code section XIII-C.10.030.
